Did you read it?
Kaplan will hear arguments on both issues -- jurisdiction and just cause --
before issuing a ruling on either. If he rules against the union on the
jurisdictional issue, the second part of the hearing will have been rendered
moot.


If he rules in the union's favor on both arguments, the league would take
immediate action in federal court, Granik said.

I read it, and I predicted correctly. The naysayers on here were saying
that it wouldn't go no further than Stern.

No one said they would not _try_ to appeal.
The arbritrator has not yet decided it is not Stern's decission and if he
says he can rule Stern is going to court to contest that.

And all the while Artest, Jackson, O'Neal will not be paid nor play. By
the time a ruling is even made Jackson and O'Neal will be back on the floor
having already served their suspension. Only Artest stands to gain
anything with this legal battle.
