Yeah, agreed, but he still didn't go for the ball, he went for the
(hard) foul.

I think it is a mix. He was going for the ball and then decided to take a
hard foul by keeping linko' from getting the easy basket... but that all
happened in less than a second... >> Stay informed about: Jazz fans are retarded |

Stu makes the call and can upgrade or downgrade or rescind a flagrant and
recommends penalties after it is reviewed...The buck stops at Stern's desk
even if a desinee announces it. Only penalties over 10 games can be
arbitrated past Stern's decission for in game conduct.
Both of these rules say the Commisioner not Stu's "Executive Vice President
of Basketball Operations".
NATIONAL BASKETBALL ASSOCIATION UNIFORM PLAYER CONTRACT
d) The Player agrees to be bound by Article 35 of the NBA Constitution, a
copy of which, as in effect on the date of this Contract, is attached
hereto. The Player acknowledges that the Commissioner is empowered to impose
fines upon and/or suspend the Player for causes and in the manner provided
in such Article, provided that such fines and/or suspensions are consistent
with the terms of the CBA.
Rule book
B. FOULS: FLAGRANT—UNSPORTSMANLIKE
A flagrant foul—penalty (2) is unnecessary and excessive contact committed
by a player against an opponent. It is an unsportsmanlike act and the
offender is
ejected immediately.
The offender will be subject to a fine not exceeding $50,000 and/or
suspension by the Commissioner.

Stern has to approve every decission on the penalties and sign the
notifications to team and player...even if he just rubber stamps Jackson or
the others reviewing it still his decission. As per the rules the player is
suspended by Stern.

Stu Jackson makes the call. Rubber stamp is right.

That a reporter uses 'handed down' just means he hated to copy the rest that
said 'announced'

By JAN HUBBARD
Star-Telegram Staff Writer
The suspension was announced by Stu Jackson, the NBA's executive vice
president of basketball operations
http://www.nba.com/news/nowitzki_suspended_080305.html
it was announced today by Stu Jackson, NBA Executive Vice President,
Basketball Operations.
That Stu announced it because Stern was out of town does not change the
rules, even though he is in charge of discipline and the rest of on court
operations Stern still had to approve....Stern has the
authority to overrule Stu, not the other way around. A appeal would be
Stern's too. Hunt it up otherwise in the CBA www.nbpa.com or the rules.

You are absolutely right. Third time a 1 seed choked but the Knicks series
did have extenuating circumstances. The Van Gundy holding on for dear life
series I believe.

That was the series in 1998. ...lol...still likely the funniest brawl scene
ever...
This one it came down to the last second of game 5 and Allan Houston hit a
running one hander.
Was more to the lock-out as an excuse for Miami.
Knicks were coming on and likely would have been a higher seed in an 82
game season.

So here we see that not only did Stu Jackson upgrade the foul but announced
it also.
Good try at samantics kid.

"We felt the flagrant foul penalty one should be upgraded," said Stu
Jackson, the league's executive vice president of basketball operations. "It
fit the criteria of being excessive contact.
"We can consider a variety of different factors in terms of upgrading and
fining or suspending. It's not just limited to the severity of the contact
but to whether or not the player was injured on the play."

"Following a subsequent review, the foul was upgraded to a penalty two
violation, NBA executive vice-president of basketball operations Stu Jackson
said in a statement. "

"NBA executive vice president of basketball operations Stu Jackson
