The wording in the legal contract between the NBA and the NBPA called the
Collective Barganing Agreement is hardly samantics.
Posting more articles all copied from the same news release is not the
rules....find me the rule that says anything other than "the comissioner or
his desinee" as in acting in the comissioners behalf has the authority.
An appeal would be Stern's too and the commissoner has the final say unless
it is over 10 games. I posted the rules from the CBA
http://nbpa.com/cba_articles.php and from the game rules
http://www.nba.com/media/rule_book_2007-08.pdf.
That Stern desinates Stu to review and recomend penalities does not remove
that authority to approve or revise the penalty.
Stern still had to approve....Stern has the authority to overrule Stu, not
the other way around.
And I sure wish I was a kid... =)

You mean, like when Dennis Rodman remarked about Mormons and was booed by
the entire crowd everytime he touched the ball and then later fined 50
thousand dollars?
I can understand your embarrassment of me accusing Jazz fans of being
Mormon, simply because the religion is ridiculously stupid, but still, you
cannot deny that most of the fans are Mormons.
I have lived in Utah. I know full well the demographics and how SLC
operates. Just like most major cities, it's major contributors come from
surrounding suburbs.
Furthermore SLC's population is a 10th of the entire SL valley.
However, again, I understand your embarrassment of me suggesting Jazz fans
are mostly white, adolescent, Mormon suburbanites. >> Stay informed about: Jazz fans are retarded |

Let's make this short and simple for you. Stu Jackson stated he upgraded the
foul as well as the fact he anounced it. Nuff' said. >> Stay informed about: Jazz fans are retarded |

Stu did not say "he" upgraded the flagrant, he said "We".
"We felt the flagrant foul penalty one should be upgraded," said Stu
Jackson
Who is "We"? The league? The Commissioners office? Stu and Stern?
Find me where it says Stu has authority over or around Stern to hand out
penalties.
http://nbpa.com/cba_articles.php and from the game rules
http://www.nba.com/media/rule_book_2007-08.pdf.
That Stern designates Stu and others to review and recommend penalties does
not remove
that authority given to him in the rules.
Stern still had to approve....Stern has the authority to overrule Stu, not
the other way around.

Both of these rules say the Commisioner not Stu's "Executive Vice President
of Basketball Operations".
NATIONAL BASKETBALL ASSOCIATION UNIFORM PLAYER CONTRACT
d) The Player agrees to be bound by Article 35 of the NBA Constitution, a
copy of which, as in effect on the date of this Contract, is attached
hereto. The Player acknowledges that the Commissioner is empowered to impose
fines upon and/or suspend the Player for causes and in the manner provided
in such Article, provided that such fines and/or suspensions are consistent
with the terms of the CBA.
Rule book
B. FOULS: FLAGRANT—UNSPORTSMANLIKE
A flagrant foul—penalty (2) is unnecessary and excessive contact committed
by a player against an opponent. It is an unsportsmanlike act and the
offender is
ejected immediately.
The offender will be subject to a fine not exceeding $50,000 and/or
suspension by the Commissioner. >> Stay informed about: Jazz fans are retarded |

You are citing articles where it says Stu anounced the foul, which has
nothing to do with this conversation. Anouncing something does not mean you
made the decision or did not make the decision.
Stu is not going to say "I," regardless, either. Why? Because he represents
the NBA.
Every source is saying Stu upgraded it and Stu made the decision because
they know who is in charge of the decision...
You can say whatever you want, but in the end, every journo, knows Stu
Jackson makes the call.
I will give you the last word out of sympathy. >> Stay informed about: Jazz fans are retarded |

I am citing a direct quote which you misrepresented.

He represents the Commissioner for this part of the CBA and I again cite
that too:
CBA:
d) The Player acknowledges that the Commissioner is empowered to impose
fines upon and/or suspend the Player for causes and in the manner provided
in such Article, provided that such fines and/or suspensions are consistent
with the terms of the CBA.
Rule:
The offender will be subject to a fine not exceeding $50,000 and/or
suspension by the Commissioner.
Stu does not supend anyone the Commissioner does...

No proof that most Jazz fans are mostly Mormon? Are you seriously trying to
suggest, that Mormons are not the major contributors of the Jazz franchise?
Larry Miller is probablly not Mormon either, huh?

Weren't that more like 2nd seed vs 7th seed or even 3rd vs 6th? And
wouldn't all of those be best-of-5, except GSW vs Mavs?
